This policy is provided in accordance with Article 13 of Legislative Decree no. 196/2003 for the user interacting with the website www.beyondshoes.i, and the company’s web services ElisabetS.r.l. The policy is only for the websites in question and for services provided herein and not for other websites visited by the user through links.

Data controller.

Elisabet S.r.l.,as Data Controller of personal data (hereinafter Data Controller), within the meaning of Article 13 of Legislative Decree 196/03, informs the user, as the interested party of the processing, of the following facts and/or circumstances.

Data collected and processed.

As foreseen by Article 13 of Legislative Decree 196/03 the Data Controller can come to know of, in the carrying out services, through the registration of the user on the websites, the sale of products or requests made by the user, personal data such as name, surname, company name, address of domicile/residence, workplace, qualifications, nationality, sex, handwritten or digital signature, identity card or driver’s licence, access codes, date of birth, tax code, VAT number, email address, landline and/or mobile telephone numbers, geographical location, payment details and credit card details. These data can be collected in the course of provision of services or offered freely and communicated orally to the Data Controller orhis/her staff.

The user guarantees that the data provided for the uses referred to in this policy are true and reliable, indemnifying the Data Controller and the data processors and staff of all liabilities.

Browsing history.

IT systems and software procedures involved in the operation of company websites acquire, in the course of normal business, personal data of which the transmission is implicit in the use of internet communication protocols. This information is not collected in order to associate it with identified interested parties, but by its very nature could, through elaborations and associations with data held by third parties, allow the identification of users. This category of data includes IP addresses or domain names of the computers used by the users who connect to the website, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the operating system and the computer environment of the user. These data are only used to obtain anonymous statistical information on the use of the website and to check its correct operation (see the paragraph on cookies). The competent authorities may use the data for the purposes of ascertaining responsibilities in case of possible computer crimes against the Site. Personal data provided voluntarily by the user can also be processed.

Mode and place of processing.

Data are processed on the premises of the Data Controller, as well as on the premises of any parties nominated responsible of the processing.

The Data Controller will adopt suitable security tools, including IT tools, in order to prevent access, destruction and dissemination of data. Personal data are processed using faxes, landlines or mobile phones, and messages can be sent by MMS, texts, mail, emails, or other means of communication over a distance, both with electronic and paper-based means. Data can be stored in an archive, including an IT archive (e.g. mailing list), on the premises of the Data Controller, as well as stored on the server used by the Data Controller, which may not be physically present on the premises of the Data Controller and will be processed in the time necessary for the execution of the purpose of processing and stored in a form that permits identification of the person concerned for a period of time not greater than that necessary for the purposes for which they were collected and subsequently processed.

The interested party has the right to withdraw consent previously given at any time, also in a partial manner, for example by agreeing to traditional contact methods only.

Data communication

Data may be communicated to:

banks (for making or taking payments),
insurance companies (for liability for damages),
accounting and legal professionals for advice and
categories of persons responsible for the Data Controller’s organization (administrative, sales, marketing and legal staff, system administrators)
external parties (such as third party suppliers of technical services, couriers, hosting providers, computer companies, communications agencies) for activation, management and/or maintenance of the services provided by the Data Controller.

In particular the data will be communicated to and could circulate among those appointed responsible, including the Data Controller, using the services, that is, third party companies carrying out activities related to business communications, newsletters, telephony, messaging, server-farm, active and passive hosting, as well as be used by individuals designated responsible for the management of authorized services referred to the policy, with specific instructions regarding the security and correct use of the same, in accordance with this policy.

More detailed information on those responsible for the processing can be requested by writing to the Data Controllerat his/her office, indicated in the introduction.

Purpose of the processing.

Apart from that specified in Browsing Data section, the user is free to provide the Data Controller the personal data that could be processed for the following purposes.

1) Management of user requests – consent necessary.

Data supplied by the user, the subject of the processing, through a request for information or contact or when registering on the website, that is, data supplied in order to purchase a product or obtain information on products, costs, billing, shipping methods or anything else concerning the Data Controller’s marketing of the products, will be processed in order to respond to user requests. Therefore, to manage the relationship the user wishes to establish with the Data Controller and manage administrative and accounting operations, as foreseen by the law and regulations in force, as well as to respond to requests from the judicial authorities.

Consent to the processing of data in relation to this purpose (handling requests) must be considered mandatory in that without consent the Data Controller will not be able to provide the information requested.

2) Sending the newsletter and business purposes of the Data Controller – consent optional.

The user, in that he/she is the subject of the processing, can provide the data in a special section of the Site, giving consent for the sending of newsletters and mail, receiving telephone calls and faxes regarding marketing and promotional activities related to the goods or services provided by the Data Controller.

Consent in this case is optional;

If consent is not given for the above purposes (sending newsletters and the Data Controller’s promotional initiatives) it will not be possible to inform the user of the Data Controller’s promotional initiatives.

3) Fidelity Card – consent required.

The user, in that he/she is the subject of the processing, authorizes the Data Controller to process the personal data provided to enable the sending of the fidelity card and its use in the various Andrea Morelli points of sale and on the website.

Consent, in this case, is mandatory;

If consent is not given for the above-mentioned purposes (fidelity card) the Andrea Morelli® card cannot be issued and the customer will not be able to take advantage of the promotional initiatives related to its use.

​Rights of the interested party. The user, in that he/she is the subject of the processing, can always and at any time request the Data Controller for information on the privacy policy and exercise his/her rights provided for in Article 7 of Legislative Decree 196/03. Therefore, the user can obtain confirmation of the existence or not of the same data and know the content and origin, verify accuracy or request integration or updating or rectification, ask for cancellation, transformation into an anonymous form or the blocking of data processed in violation of the law, as well as to oppose processing for legitimate reasons, by presenting the Data Controller with an appropriate request. The Data Controller should be contacted at the email address or telephone or fax number mentioned in the introduction and on the Site.

Any modifications to the choices of the user or the request for cancellation of the data are essentially free and the Data Controller will, within a reasonable time frame, adapt future processing to the amendments requested by the interested party.

Any questions or comments about this privacy can be sent to the Data Controller by writing to the address indicated in the introduction.

Changes to the privacy policy. The Data Controller reserves the right to make changes to this privacy policy at any time by notification via email or, alternatively, on the website. Therefore, please see the privacy policy on the website, taking as reference the last modified date indicated at the bottom. In the case of non-acceptance of changes to this privacy policy, the user can request the Data Controller to delete his/her data for the new purposes not foreseen in this privacy policy, which will continue to apply to data gathered up to that moment. What are cookies?
